KJ Smith Solicitors is proud to have acted as legal representatives in a landmark case involving the termination of parental responsibility of a father who fraudulently used a name from a stolen passport of a third party. The father was serving a 23-year prison sentence for child sexual offenses. The case involved determining who held parental responsibility for the child and then how to remove it. The Secretary of State of Justice intervened in the case, and despite not being able to change the law, the mother succeeded in obtaining a remedy under Article 22 of the 1996 Hague Convention. The decision prioritised the interests of the child and highlighted the significance of international cooperation in resolving complex parental responsibility cases. KJ Smith Solicitors remain dedicated to advocating for the rights of parents and children in matters of international family law.
